A Division Bench of the High Court of Tripura headed by Chief Justice Indrajit Mahanty directed the State Government to take suitable action against the Deputy Secretary of the Health and Family Welfare department for submitting false information to the Court relating to the death of advocate Bhaskar Deb Roy, said Advocate Purushottam Roy Barman on Thursday. He

 said, the Division Bench also directed the State Government and Health department to ensure facilities in the Trauma care as per the guidelines and submit a compliance report to the High Court.

Bhaskar Deb was brought to GB Hospital on late March 6, 2020 last and he collapsed on the following day. Later, advocate Pulak Saha filed Public Interest Litigation in the High Court, demanding payment of an interim compensation to the mother of late Bhaskar Deb Roy, improvement of medical services at the Trauma Center in GB Hospital and legal actions against the doctors who neglected their duties leading to Bhaskar Deb Roy’s untimely death. 

Roy Barman said the State Government had paid an interim compensation of Rs 10 lakh to deceased’s mother.

Meantime, a news agency reported that a magisterial report said, “There was gross medical negligence on the part of Dr Debasish Paul who deliberately acted knowingly that his omission was likely to cause harm but consciously and voluntarily disregarded (his duty) to give reasonable care to the patient. Not providing Standard of Care to Debroy led to his unfortunate death.”

A Death Audit Team led by Dr Shankar Debroy also found several flaws and negligence in the treatment at the Trauma centre.  

Based on these reports, the court concluded that no physical examination was done systematically by on-duty doctors who had attended the patient and no investigation was advised at the Trauma centre, and even no specialist was called.

There was a delay in initiating treatment right from the entry of the patient at the trauma centre, the court observed adding that Debroy’s death was due to system failure as norms of trauma care were not maintained, a News Agency reported.

Notably, Police submitted chargesheet against five doctors.
