Seventy-two days after the tragic suicide of delivery boy Prasenjit Sarkar, the case has now been transferred to the District and Sessions Court, North Tripura, marking a significant development in the pursuit of justice. The charge-sheet against five accused persons was submitted before the court, following which the matter was moved from the court of the Chief Judicial Magistrate to the higher sessions court after reviewing the material facts.

Advocate Debdas Bakshi, who is representing the victim’s family, informed media persons on Wednesday that the trial will formally begin once charges are framed in the sessions court. He stated that the prosecution is fully prepared to proceed as soon as procedural formalities are completed.

“All five accused persons have been in judicial custody for the last 72 days. Prima facie, it has been established before the court that this is a case of abetment to suicide under Section 108 of the Bharatiya Nyaya Sanhita,” Bakshi said while speaking to reporters after the hearing in Dharmanagar.

The application of Section 108 of the Bharatiya Nyaya Sanhita indicates that investigators believe there is sufficient preliminary evidence suggesting that the accused individuals allegedly instigated or aided circumstances that led to the victim taking the extreme step. The prosecution has also filed a plea seeking a custody trial after reports surfaced about alleged threats and inducements directed at witnesses.

According to Bakshi, one of the witnesses in the case has already lodged a police complaint citing intimidation and threats, reportedly due to being listed as a witness in the matter. These developments have raised concerns about witness safety and have prompted the prosecution to request stricter custodial proceedings to prevent interference with the trial process.

The defense has reportedly filed multiple bail applications since the arrest of the accused; however, these pleas have been rejected between 13 and 14 times by the court. The repeated denial of bail reflects the seriousness with which the judiciary is treating the case, particularly considering the allegations of intimidation and the gravity of the charges involved.

Advocate Bakshi also acknowledged the role of social media users and concerned citizens of Dharmanagar who have consistently voiced support for Prasenjit Sarkar’s family. He stated that public awareness and community solidarity have strengthened the family’s resolve to seek justice.

The transfer of the case to the District and Sessions Court signifies that the matter is now set to enter a crucial stage of judicial scrutiny. Sessions courts typically handle more serious criminal cases, and the framing of charges will determine the specific counts under which the accused will stand trial.

As the legal process moves forward, the focus will remain on ensuring a fair and transparent trial while safeguarding witnesses and upholding due process. The case has drawn considerable public attention across North Tripura, underscoring broader concerns about workplace pressures, accountability, and legal protections for vulnerable workers.
