Supreme Court directs ECI to order NIA probe into Malda attack on judicial officers during electoral roll revision. Incident raises serious concerns over law, order, and election integrity in West Bengal ahead of upcoming polls.

In a development raising serious concerns about the safety of judicial officers and the integrity of electoral processes, the Election Commission of India (ECI) has formally requested the National Investigation Agency (NIA) to investigate the recent attack on judicial officers in West Bengal’s Malda district.

The move comes in compliance with a directive issued by the Supreme Court of India, which took suo motu cognisance of the incident and expressed grave concern over what it described as a “brazen attempt” to intimidate the judiciary.

Incident in Malda Sparks National Concern

The incident occurred in the Kaliachak area of Malda district, where seven judicial officers, including three women, were allegedly held hostage and gheraoed by a group of agitated individuals. The officers had been deputed to oversee the Special Intensive Revision (SIR) of electoral rolls—a crucial exercise aimed at ensuring the accuracy and integrity of voter lists.

According to official sources, the unrest was triggered after several voters found their names deleted under the “logical discrepancy” category during judicial scrutiny. The situation escalated rapidly, with the officers confined inside a Block Development Office for nearly nine hours.

A large contingent of police and senior district officials eventually intervened around 1 a.m., dispersing the crowd and rescuing the officers. However, reports suggest that even after their evacuation, there were attempts to attack the convoy transporting them to safety.

Supreme Court’s Strong Observations

The Supreme Court of India, acting on a report submitted by the Calcutta High Court, expressed serious displeasure over the incident. The apex court highlighted what it termed “conspicuous inertia” on the part of the local administration and police in responding promptly to the crisis.

A Bench led by Chief Justice of India Surya Kant directed the ECI to entrust the probe to an independent agency. It also sought a preliminary report and issued guidelines to ensure the safety of judicial officers engaged in election-related duties.

The matter is scheduled for further hearing on April 6, where compliance reports are expected to be presented before the court.

ECI’s Communication to NIA

Following the court’s directive, the Election Commission of India sent an official communication to the Director General of the National Investigation Agency. The letter explicitly referred to the Supreme Court’s April 2 order and requested an immediate inquiry into the incident.

The ECI emphasized the urgency of the matter and instructed that a preliminary investigation report be submitted directly to the apex court. Sources indicate that an NIA team is likely to arrive in West Bengal and begin its probe without delay.

Political Reactions and Allegations

The incident has also triggered sharp political reactions. Suvendu Adhikari, Leader of the Opposition in the state assembly, alleged that the attack was not spontaneous but a “pre-planned event.” He claimed that certain regions, including Malda and Murshidabad, were being used as focal points for larger conspiracies aimed at destabilizing the region.

Similarly, Samik Bhattacharya, BJP state president and Rajya Sabha MP, raised concerns over alleged militant activities and demographic changes in border areas. He claimed that extremist modules had expanded in parts of the state during the COVID-19 period.

These allegations, however, remain politically contested and have not been independently verified.

Implications for Electoral Integrity

The attack on judicial officers has sparked widespread debate about the safety of officials involved in election-related duties. The Special Intensive Revision process is critical to maintaining transparent and fair elections, and any disruption raises questions about administrative preparedness and law enforcement efficiency.

The involvement of the National Investigation Agency underscores the seriousness of the incident, as the agency typically handles cases with national security implications.

As the investigation unfolds, all eyes will be on the findings of the NIA and the response of state authorities. The upcoming Supreme Court hearing is expected to play a crucial role in determining accountability and ensuring safeguards for judicial officers.
