A bizarre legal controversy has surfaced in Tripura’s Khowai district after a deceased man was allegedly portrayed by police as a continuing threat to public order nearly three years after his death. The unusual incident has now reached the courtroom, drawing attention to serious concerns over procedural negligence and police accountability.

The matter came to light after Krishnapada Datta, a resident of Mahadeb Tilla and a member of the Khowai Deed Writers’ Association, filed a complaint before a local court against four police personnel attached to Khowai police station. In his petition, Datta alleged that the police filed a Prosecution Report (PR) against his deceased son, Debashish Datta, despite being fully aware that he had died in 2022.

According to the complaint, Debashish was arrested in 2021 in connection with an NDPS case. His father alleged that the case itself was false and that his son had been wrongly implicated. Following the arrest, Debashish reportedly spent nearly three-and-a-half months in jail before securing bail from the court.

Datta further stated that his son’s health deteriorated significantly during his incarceration. After his release on bail, he was admitted to a private nursing home in Behala, Kolkata, for treatment. He eventually died on June 24, 2022, while undergoing medical care.

However, the controversy deepened when Khowai police allegedly submitted a Prosecution Report before a court on November 7, 2025, naming the deceased Debashish Datta. The report, identified as PR No. 2226/25, reportedly described him as a potential threat to law and order in the Mahadebtilla area and alleged that he could create disturbances at any moment. The same report also allegedly branded him as a drug peddler.

The development has raised serious questions over how a person who had died more than three years earlier could be officially projected as an active threat to society. The incident has also triggered widespread discussion among local residents and legal observers regarding the accuracy and verification mechanisms followed during the preparation of police reports.

Seeking legal action against those responsible, Krishnapada Datta approached the court and accused the police personnel concerned of misconduct and negligence. The case was registered as CR 7/2026 on Thursday.

The complaint specifically names the officer-in-charge of Khowai police station, the second officer, and two additional police personnel as accused in the matter. According to the complainant, the court has directed all four police personnel to submit their responses by May 28.

Legal experts believe the case could become significant in determining accountability in official documentation and law enforcement procedures. The incident has also intensified public debate over the handling of criminal records and prosecution reports by investigating agencies.

While police authorities have not yet publicly commented on the allegations, the case has already generated considerable public attention because of its unusual nature and the serious implications surrounding administrative lapses within the policing system.
