Kailashahar First Class Court has directed police to explain why a case against Tripura Minister Tinku Roy was not registered despite repeated complaints. Congress welcomed the order, calling it a victory for accountability, transparency, and the rule of law in Tripura politics.
A significant legal development in Tripura has brought renewed political attention to allegations involving state minister and BJP leader Tinku Roy. The Kailashahar First Class Court has directed the Officer-in-Charge of Kailashahar Police Station to personally explain why a complaint filed against the minister was not formally registered despite repeated representations. The directive has been welcomed by the Congress, which described it as an important affirmation of judicial accountability and the principle that everyone is equal before the law.
The order was issued by Judicial Magistrate First Class Ranjabati Roy during a hearing held on August 6. The court has instructed the police officer to appear in person on September 15 and submit a detailed written explanation regarding the handling of the complaint.
Reacting to the court’s directive, Congress MLA Birajit Sinha addressed a press conference in Kailashahar, stating that the order reinforces public confidence in the judiciary. According to him, the court’s intervention demonstrates that legal institutions continue to function independently and that no individual, regardless of political position, is above the law.
The press conference was also attended by advocate Narsingha Das, Unakoti District Congress president Mohammad Badruzzaman, and senior Congress leader Chandrashekhar Sinha. The leaders collectively welcomed the judicial order and expressed hope that the matter would now receive an impartial examination.
The controversy dates back to the 2023 Tripura Assembly elections. Congress leaders have alleged that Tinku Roy, while contesting as a BJP candidate, submitted an election affidavit stating that he had passed Class XII from an education board based in Madhya Pradesh and that no criminal cases were pending against him.
According to the Congress, the education board mentioned in the affidavit had previously been declared invalid by the government. Party leaders have also claimed that a criminal case involving Roy had already been registered at West Agartala Police Station before his nomination papers were filed, making the declaration in the affidavit a matter requiring legal scrutiny.
Congress leader Chandrashekhar Sinha filed a written complaint at Kailashahar Police Station on December 9, 2025, seeking registration of a case. The complaint was reportedly supported by documents relating to the status of the education board as well as records connected to the earlier criminal case. Additional documents were submitted by December 15 to strengthen the complaint.
However, Congress leaders alleged that despite repeated follow-ups, the police neither registered an FIR nor initiated any formal investigation. Dissatisfied with the response, the complainant approached the Superintendent of Police of Unakoti district in January 2026, requesting intervention. According to the Congress, no action followed this representation either.
Subsequently, the matter was taken before the Kailashahar First Class Court. The case was formally admitted on April 17 this year. Following two earlier hearings, the third hearing on August 6 resulted in the court directing the Officer-in-Charge of Kailashahar Police Station to submit a written explanation.
The court specifically sought clarification on whether a General Diary (GD) entry had been recorded after receiving the complaint, whether any preliminary inquiry or investigation had been conducted, and the reasons behind the alleged failure to register the complaint.
Advocate Narsingha Das argued that the court’s directive raises serious questions regarding the handling of the complaint by the police authorities. He alleged negligence on the part of the then Superintendent of Police of Unakoti district, Sudhambika R, and the then Officer-in-Charge of Kailashahar Police Station, Sukanta Sen Choudhury. He further stated that if appropriate departmental action is not initiated, the Congress may consider approaching the Tripura High Court for further legal remedies.

The court’s directive has intensified political discussion in Kailashahar and across Tripura, with opposition leaders portraying the development as an important test of administrative accountability and institutional transparency. The next hearing, scheduled for September 15, is expected to determine the police’s response to the court’s queries and may influence the future course of the proceedings. The matter remains sub judice, and the allegations against Minister Tinku Roy are yet to be judicially determined.
