The Lok Sabha on Tuesday commenced discussions on the Public Examinations (Prevention of Unfair Means) Amendment Bill, 2026, a proposed legislation aimed at significantly strengthening the legal framework against examination paper leaks and other forms of malpractice in public examinations. The move comes amid growing concerns over recurring examination fraud incidents that have disrupted recruitment processes and competitive examinations across the country, affecting millions of students and job aspirants.

The amendment has been introduced as part of the Union government’s broader effort to ensure transparency, fairness, and accountability in public examinations. It seeks to reinforce the provisions of the Public Examinations (Prevention of Unfair Means) Act, 2024, by increasing punishments, imposing steeper financial penalties, and ensuring investigations and court proceedings are completed within fixed timelines.

Introducing the Bill for consideration in the Lok Sabha, Union Minister of State in the Prime Minister’s Office, Jitendra Singh, said the amendment reflects the government’s commitment to protecting the interests of students and young aspirants. He stated that the revised legislation is designed to make the existing legal framework more effective, ensuring that those involved in examination fraud face stronger consequences.

The original Act, enacted in 2024 following a series of high-profile examination paper leaks, came into force in June that year. It defined 15 categories of offences related to unfair means in public examinations. These included leaking question papers or answer keys, operating fake examination websites, tampering with examination systems, and facilitating organised cheating through various means. Importantly, while the law targeted individuals and organisations involved in conducting or manipulating examinations, candidates themselves remained outside its scope.

The proposed amendment introduces substantial changes to the existing penalty structure. Under the new provisions, individuals found guilty of using unfair means in public examinations would face a minimum imprisonment of five years, compared to the earlier minimum of three years. The maximum punishment would remain up to ten years, while the financial penalty would increase sharply from Rs 10 lakh to Rs 50 lakh, reflecting the government’s intent to deter examination-related offences more effectively.

The Bill also targets service providers responsible for conducting public examinations. If found guilty of facilitating unfair practices or failing to prevent examination fraud, such service providers could face fines of up to Rs 5 crore, a significant increase from the existing ceiling of Rs 1 crore. Additionally, they may be prohibited from participating in public examination activities for eight years, doubling the earlier disqualification period of four years.

For organised criminal networks attempting to manipulate public examinations, the amendment prescribes even stricter penalties. The minimum imprisonment would increase from five years to seven years, accompanied by a financial penalty of Rs 10 crore. These provisions are intended to dismantle organised rackets that profit from examination fraud and compromise the integrity of recruitment and admission processes.

A key feature of the proposed legislation is the introduction of strict timelines for investigation and judicial proceedings. Investigations into offences under the Act must be completed within two months from the date the case is referred by the Central Government. To ensure speedy justice, the Bill also mandates states and Union Territories to designate Courts of Session as fast-track courts for handling such cases.

According to the proposed framework, trials should be concluded within three months of the filing of the chargesheet, wherever possible. Appeals before High Courts are also expected to be heard by two-judge benches within a similar timeframe, ensuring quicker disposal of cases and preventing prolonged legal delays.

The government believes that these measures will strengthen public confidence in competitive examinations, particularly those conducted for government recruitment and admissions to educational institutions. By introducing tougher punishments, enhanced accountability, and faster judicial processes, the proposed amendment aims to create a more robust deterrent against examination fraud while safeguarding the future of millions of deserving students and aspirants.

The Bill will now undergo further parliamentary deliberations before being considered for passage. If enacted, the amended law is expected to play a crucial role in preserving the credibility, fairness, and integrity of India’s public examination system.
