The Tripura HC has instructed the state government to expedite timelines for open correctional facilities, identify suitable new sites, and submit detailed inmate data, aligning prison reforms with directives issued by the Supreme Court of India.
The Tripura High Court has directed the state government to re-evaluate its action plan for establishing Open Correctional Infrastructures (OCIs) across the state. Emphasizing the need for urgency, the court instructed authorities to formulate shorter, more pragmatic deadlines and actively scout for new, viable locations rather than relying solely on existing prison complexes.
A Division Bench comprising Chief Justice M. S. Ramachandra Rao and Justice S. Datta Purkayastha passed the directive while reviewing an action plan submitted by a specially constituted administrative committee. The panel included the Officer on Special Duty (OSD) of the Directorate of Prisons, the Inspector General of Prisons, and the Additional Secretary of the Tripura Government’s Home Department. While the High Court formally incorporated the committee’s findings into its judicial record, the Bench expressed clear reservations regarding the proposed implementation schedule, observing that the suggested timelines appeared excessively protracted.
The Bench instructed the respondent authorities to examine the feasibility of compressing these milestones into tighter, realistic deadlines. Furthermore, the court pointed out that restricting the development of correctional infrastructure to areas adjacent to existing closed jails could constrain progress, noting that it may not always be practical or viable to acquire neighboring land. Consequently, the state was directed to survey alternative locations across Tripura to establish autonomous, purpose-built open correctional facilities.
To ensure transparency and assess the immediate burden on the state’s correctional system, the High Court directed the administration to furnish comprehensive statistics detailing the exact inmate population across all active correctional institutions as of October 1, 2026. This data must be filed via an additional affidavit before the next scheduled hearing on November 17, 2026.
The High Court’s directives arise from a suo motu writ petition initiated to monitor the execution of the Supreme Court of India’s landmark verdict in Suhas Chakma vs. Union of India and Others. In that judgment, the apex court mandated all States and Union Territories to undertake proactive, time-bound measures to expand open correctional facilities. The Supreme Court laid down a dual-track mandate: first, setting up independent Open Correctional Institutions; and second, carving out open or semi-open barracks within existing closed penitentiaries where security protocols permit.

Under the apex court’s guidelines, prison and correctional services departments must execute a comprehensive infrastructure assessment to identify prospective sites without compromising public safety or facility security.
